Strategic and regulatory advice to financial institutions, litigation, transactions, new technology law

  • Habilitated doctor in the Department of Civil Law at the Jagiellonian University;
  • Expert in civil law, banking law, commercial law (including company law) and financial instruments;
  • has many years of practical experience in providing legal services to banks and financial sector institutions;
  • handles litigation and arbitration disputes with a value of up to several tens of billions of euros;
  • involved in the implementation of EU legislation into national law, e.g. as a member of the advisory group for the Bank Guarantee Fund within the working group of the Financial Stability Committee in the process of implementing forced restructuring procedures for banks into Polish law;
  • involved in the implementation of national and EU laws into internal regulations of financial institutions;
  • advises on the law of new technologies (IT), including blockchain;
  • performs analyses and estimates liability risks for the purpose of assessing the legitimacy of establishing provisions for risks related to banking activities;
  • Expert of the Doing Business programme (World Bank) in the field of debt recovery, debt security and insolvency;
  • Member of the expert panel of the European Union Blockchain Observatory and Forum (EUBOF) set up at the initiative of the European Commission and the European Parliament as part of the implementation of the European Digital Strategy;
  • Member of the Working Group on Distributed Registers and Blockchain at the Ministry of Digitalisation – among other things, co-created draft concepts for extending the legal significance of the electronic seal;
  • co-participant in projects implemented by the Coalition for Polish Innovation (KPI) – among other things, co-created the concept of tokenisation of a bill of exchange and smart contracts (proof of concept) for tokenisation of a bill of exchange;
  • member of the Polish-German Centre for Banking Law at the Jagiellonian University (academic work, expert opinions 2000-2009);
  • former member of the problem-solving team of the Civil Law Codification Commission on the performance of obligations and consequences of breach of obligations and of the team on the regulation of service provision;
  • author or co-author of numerous expert opinions and publications in recognised scientific journals (e.g. Journal of Cybersecurity/Oxford University Press, Kwartalnik Prawa Prywatnego, Przegląd Sądowy, Transformacje Prawa Prywatnego), newspapers (e.g. Rzeczpospolita, Dziennik Gazeta Prawna);
  • author or co-author of legal commentaries to the most important laws (e.g. Big Beck Commentaries. Obligations, ed. P. Machnikowski; Company Law. Commentary. T.5, ed. Sołtysiński/ Szajkowski/ Szumański/ Szwaja; Banking Law. Commentary, ed. F. Zoll.), systems of law (System of Commercial Law: T.4, Law of Financial Instruments, ed. M. Stec, C.H.Beck) and legal monographs, mainly on civil and commercial law;
  • speaker at numerous seminars and conferences on topics such as blockchain/DLT, NewTech and FinTech, e.g. IBM Summit Warsaw Think, BlockchainTech Congress, Compliance National Congress.

Education:

  • Graduate of the Faculty of Law and Administration of the Jagiellonian University;
  • graduate of the School of German Law of the Universities of Heidelberg, Mainz, Krakow (one-year programme);
  • completed judicial training in Cracow and passed the judge’s exam;
  • Doctor of Juridical Sciences (Jagiellonian University);
  • entered on the list of attorneys-at-law.

Counsel to financial institutions, regulatory proceedings, transactions, restructuring and insolvency

  • specialised in banking law, civil law, commercial law and data protection issues;
  • has extensive experience in providing legal services to banks and other financial sector institutions;
  • participated, among others, in processes related to adjusting internal regulations of financial market entities to the changing national and EU law, including consumer credits, payment services and AML;
  • created the legal framework for the operation of new banking products and prepared structures for complex financing transactions;
  • associated with the firm since 2017, responsible for regulatory projects of one of the largest banks in Poland and advising a factoring institution.

Education:

  • graduated with honours from the Faculty of Law and Administration at the Jagiellonian University,
  • completed her attorney-at-law training at the Warsaw Bar Association of Attorneys-at-Law,
  • completed postgraduate studies in personal data protection and information security and is a member of the Association of Personal Data Protection Practitioners.
